Refund and Subscription Policy

This Refund and Subscription Policy forms an integral part of the BeatUnity Terms and Conditions.
By purchasing a Subscription, Premium Feature or other paid Service through the Platform, the User agrees to this Policy.
1. Definitions
1.1 Company
The Company means XYO, operating under the trade name BeatUnity, registered under company number 0748.753.094, with registered office at Heidebloemstraat 10, 3500 Hasselt, Belgium.
1.2 Platform
The Platform means the BeatUnity website, applications, software, services and related functionalities.
1.3 User
A User means any natural person or legal entity using the Platform.
1.4 Subscription
A Subscription means any recurring or non recurring paid access plan, membership, premium feature or digital service offered through the Platform.
1.5 Consumer
A Consumer means any natural person acting for purposes outside their trade, business, craft or profession.
1.6 Business User
A Business User means any natural person acting within their professional activity, any legal entity or any organisation.
2. Digital Services
2.1 Nature of Services
BeatUnity provides access to digital services, software features, profile functionalities, community features, educational content, networking tools and other platform services.
2.2 No Guarantee of Results
Payment for a Subscription or Premium Service does not guarantee:
- bookings;
- performances;
- collaborations;
- coaching opportunities;
- visibility;
- professional advancement;
- commercial success;
- revenue generation.
Users pay exclusively for access to Platform features and services.
Users acknowledge that Subscriptions are purchased exclusively for access to Platform features, community benefits, visibility tools, networking functionalities and other digital services made available through the Platform.
3. Subscriptions
3.1 Subscription Terms
Subscription details, pricing, billing intervals and included features are displayed on the Platform at the time of purchase.
3.2 Automatic Renewal
Unless otherwise stated, subscriptions automatically renew at the end of each billing period.
3.3 Cancellation
Users may cancel their Subscription at any time through their account dashboard.
Cancellation prevents future renewals but does not automatically entitle the User to a refund for the current billing period.
3.4 Access Following Cancellation
Following cancellation, the User may continue using the Subscription until the end of the current paid billing period unless otherwise specified.
4. Right of Withdrawal
4.1 Consumers
Consumers residing within the European Union may have a statutory right of withdrawal for certain purchases.
4.2 Immediate Performance of Digital Services
Where a Consumer expressly requests immediate access to digital services, premium features, subscriptions or downloadable content before the expiration of the statutory withdrawal period, the Consumer acknowledges and agrees that:
- service delivery begins immediately;
- access to digital content is provided immediately;
- the Consumer expressly acknowledges that the digital service will begin immediately and understands that the statutory right of withdrawal may be lost once the digital service has been fully performed, to the extent permitted by applicable law.

5. Refunds
5.1 General Rule
Except where required by mandatory law, payments are non refundable once access to the purchased digital services has been granted.
5.2 Eligible Refund Situations
BeatUnity may, at its sole discretion, provide a full or partial refund in exceptional circumstances, including:
- duplicate payments;
- billing errors;
- technical issues preventing access to purchased services;
- legal obligations requiring a refund.
5.3 Non Refundable Situations
Refunds will generally not be provided for:
- unused subscriptions;
- lack of bookings;
- lack of opportunities;
- dissatisfaction with platform exposure;
- failure to use the Platform;
- user inactivity;
- business decisions made by third parties;
- suspension resulting from a User's violation of the Terms and Conditions.
5.4 Processing of Refunds
Where a refund is approved, it shall be processed through the original payment method where reasonably possible.
6. Price Changes
6.1 Pricing Adjustments
BeatUnity reserves the right to modify subscription fees, pricing plans and service fees.
6.2 Notice
Material price changes shall be communicated before taking effect.
Such changes shall only apply to future billing periods.
7. Failed Payments
7.1 Suspension
BeatUnity reserves the right to suspend or restrict access to paid services where payment fails, is reversed, is disputed or otherwise remains outstanding.
7.2 Outstanding Amounts
BeatUnity reserves the right to recover unpaid amounts through lawful collection procedures.
8. Chargebacks and Payment Disputes
8.1 Fraud Prevention
Users shall not initiate unjustified chargebacks or payment disputes.
8.2 Investigation
BeatUnity reserves the right to investigate chargebacks and payment disputes.
8.3 Account Restrictions
Accounts involved in fraudulent or abusive payment disputes may be suspended or terminated.
9. Termination of Services
9.1 Platform Changes
BeatUnity reserves the right to modify, replace, suspend or discontinue Platform features, subscriptions or services.
9.2 No Refund Obligation
Where services are modified, improved or replaced, no refund shall be due unless required by applicable law.
10. Limitation of Liability
10.1 No Liability for Opportunities
BeatUnity shall not be liable for the absence of bookings, opportunities, collaborations or commercial success.
10.2 No Liability for Third Party Decisions
BeatUnity shall not be liable for decisions made by organisers, venues, promoters, coaches, clients or other Users.
11. Governing Law
This Policy shall be governed exclusively by Belgian law.
Any dispute arising from this Policy shall be submitted to the competent courts of the judicial district in which BeatUnity has its registered office, except where mandatory legal provisions provide otherwise.
